It is not a bug. Some vehicles in T2 building were set to be available without T2 upgrade. The Flakpanzer 38 is basically a worse version of the halftrack with flak 38 in Defense doctrine which is also available without the T2 upgrade. Also this unit can be reliably penetrated even by the 37mm AT gun so it is not like there is no protection against it.
